Yes, quite true. Any third party is just a bystander even if he is as
noisy as a megaphone.

A third party has no recourse to law for civil damages claimable by a
second party on the first.

Hummingbird is squawking a pathetic message to freeware authors:

"I hate those Pricelessware people and you should take
out a law suit against them because I think you ought to".

Hummingbird, if any freeware author listened to you they would end up
pursuing imaginary rights which don't exist and they would end up
looking foolish and broke.

Why encourage that?
