Couple wins lawsuit against the city over airport noise
Deanne Simmons and her husband were awarded $5,000 to put new windows
in their home after suing over airport noise.
ABC13 Eyewitness News
(8/25/05 - HOUSTON) - A north Harris County family took the city of
Houston to court and won.

Steve and Deanne Simmons were awarded $5,000 to put new windows in
their home. The Simmons took the city to court over noise at Bush
Intercontinental Airport. They say they're going to use the cash to
keep the noise out.

"I was born and raised here. I'm not trying to hurt this city or
anything like that. I don't want the city to go broke. I mean, I live
here, but this is unbearable," said homeowner Deanne Simmons.

An avigation easement is usually included as part of the agreement. This
prevents future actions of this sort related to the same property.

"In our wildest dreams, we didn't think we'd wake up one morning with planes
flying right over our house," Stephen Simmons said.

They bought a house three miles from the airport and never thought about it?
I guess they're just stupid.

In San Jose, all the houses in the flight path are getting the windows
replaced by the city.

Funny thing though, most of those houses are slums in that area.

Same with certain sections of Oakland
(for both of your comments).

Not to come to their defense, but you DID read the part about "I was born
and raised here" right?? It's one thing to buy a house 3 miles from the
airport and not expect noise, it's another to have the noise move to you in
a house you've lived in since childhood!?

Yes, but they're *quiet* slums!

A few years ago when Massport was trying to win public approval for a
new runway at Boston Logan, they paid to have contractors install new
windows all over my neighborhood. While the contractors were installing
the windows a lot of roofs got fixed and central air units just
happened to get installed, too. Pure coincidence.

The article I found stated they bought the house 11 years ago. Methinks the
airport was there first.

Gee, they used to call that "urban renewal." Now it's "noise abatement."

The terms may change, but it's the same old BS -- done at *your* expense.

So was the airport there before he was born? Which was there first? That's the
one I have sympathy for. If you buy a house near an airport, don't be surprised
when aircraft fly overhead or there's noise. OTOH, if you buy a house out in
the sticks and then they build an airport, then you have a valid complaint that
the airport needs to address.

that airport has been there since about 1960. there are a lot of pine
trees out that way so maybe they just didn't notice?

AH has been there since the mid-70s. It's the interstate freeway
that's the real problem. That and the fact that people keep moving
further north and further south because no one in Houston understands
infrastructure planning.

I moved *way* north. To Colorado.

These things don't just happen. There are many planning meetings,
neighborhood information meetings, referendum votes, city/town planning
and zoning activities. Existing residents have an opportunity to voice
their views, but most simply sit back hand hope somebody else will.
But after the fact, they enjoy complaining bitterly.

So you got so see how well they understand "infrastructure" planning in
Denver, huh? :~)

yeah, that whole story reminds me of my hometown Orly, France (ORY). Our
house got build before the airport existed ( many decades ago ). I think
at first it was a military airport then become an international airport.
Anyhow after being sued over and over, the airport every 5 or 8 years
asses everybody's house close to the runways ( like us ) and pays for
windows and roof replacement if needed.
Ironic that my grand pa and dad have been involved in suing the airport
for years and now I'm a pilot ( ok I'm far from bugging them with the
little Cessna though ).

My point is that now for the past 20 years, the airport have been buying
properties so that nobody lives in there. I guess that's a way of not
having to pay reparations on everybody's house in the long run :)
