View Full Version : registering a sailplane in UT

I have purchased a DG303 ACRO here in UT. First thanks to all for the
feedback on this plane.

I am trying to ensure I cover all bases regarding registration with the
goverment agencies. Any input from UT, and other states, pilots would
be appreciated.

1) I have the Bill of Sales form, 8051, from the FAA and will submit
that.
2) State sales tax. I understand the filing of the bill of sales will
trigger sales tac from UT. It is not clear when this will occur and
what 'sales value' will be used since the FAA bill of sales has no $$
amount. What should I expect?
3) I understand the state of UT requires a yearly registration that
includes a fee for a sticker. Any ideas on where I can find the
guidelines for the fees? The state web site references an aviation
blue book but it costs money to access the data.
4) Trailer registration. I have not registered the trailer as I
understand that any trailer rated for less than 2000 lbs do not require
registration. Is this correct? If I take the trailer out of state
will there be a problem?
5) I have heard that the state of TX has no sales tax on airplanes
and I curious if anyone who registered their plane in TX without being
a resident of that state.
6) Does TX require a yearly registration?

Thanks in advance

Don't forget your experimental category letter with your FSDO.

Ron:

I'm sure you'll enjoy the ship and there are some pretty good soaring
conditions in Utah as you probably know. I had an LS-4 based at Cedar
Valley a few years ago, so these are my comments:

Most states don't charge sales tax on private sales. I had a glider in
Utah ten years ago and was never dinged for sales tax. If they don't
come after you, don't ask!

I don't remember how my value was assessed, but don't expect they'll
have your glider's value in any database - they may ask you for a
declaration of value. Make this the cheapest hull value that sounds
reasonable. (your trailer could be worth up to $10,000, instruments
$5,000 and parachute $1,000 - that's $16,000 off the purchase price).

This was the case when I was there. This is not a problem as long as
you have proof of ownership. I brought a glider trailer into Arizona
recently from another state that didn't have registration and they just
issued one here.

I believe that several states do not require the registration of
private aircraft. However, I don't see the value of registering it in
a place you won't be keeping it and I wouldn't fib to authorities about
its location if asked.

My advice is to answer all questions from the state as honestly as you
can, but volunteer nothing!

I recently bought a glider from a UT based owner.

2. http://forms.faa.gov/forms/ac8050-2.pdf Right under Aircraft Bill of
Sale it states
"FOR AND IN CONSIDERATION OF $ THE
UNDERSIGNED OWNER(S) OF THE FULL LEGAL AND
BENEFICIAL TITLE OF THE AIRCRAFT DESCRIBED AS......

However, copies of this form do not apply here in Colorado, so I would
suggest you and the seller create a separate bill of sale stating the
terms, conditions, etc of sale, both sign and have it notarized or not.
I don't know about annualized stickers for the glider. Nothing like
that on mine. Some states/counties have excise, personal property, or
luxury taxes assessed annually.

The trailer should have a title. Create a separate bill of sale and
amount. If the seller can't produce a title, you'll have to get the
trailer registered in Utah. The seller of the glider I bought had to
have it inspected in UT and a UT tag, title, and plates issued with
annual tags. However, its gross is over 2000lbs. It's similar here in
Colorado if there's no ID plate. CSP inspection or homebuilt
declaration and a serialized tag.

FWIW, in Colorado, sales tax (or use tax if import) is based on where
the glider is kept. Our gliderport is rural so only the state portion
of the tax basis applies. Were it based within an incoporated area,
city taxes would also apply.
