View Full Version : FARs concerning operations in foreign country

June 22nd 06, 09:28 AM
Hi!

I`m considering to buy a Columbia 400 for private and business
purposes. The aircraft will be N-registered, although operated in
Germany (which is legally possibly using a trust i.e.).
As I`m planning to earn my Commercial certificate, I was wondering
whether there were any FARs which prevent me from offering commercial
flights over here in Germany.

For the moment omitting possible restrictions possibly imposed by the
German administration, what are the regulations to such an activity?

Is the commercial transport of passengers in a single engine aircraft
allowed? VFR and IFR or only VFR?
How would I be supervised by the FAA? Can you point me to the relevant
FARs?

Thanks in advance for your replies...

Christian

US registered aircraft must follow FAR just as they do
within the USA. Countries have what is called cabotage [do
a Google] that will prevent your operating a business within
a nation's airspace if you carry passengers or cargo that
isn't private transportation.

The other aircraft operators in Germany will turn you in for
piracy of their business.

well, that will be covered in the material you are supposed to
study for your commercial actually; in particular, parts 119,
135 and 121 come to mind;

however, the snag you will hit is that in order to do what
you are planning to do, you need to become a commercial
*operator* (and for that you need to be a US citizen to
start with -- see 14 CFR 119.33)

Well, thanks for naming of the parts... this will help me to find some
regulations concerning that.
The thing about the citizenship should be the same requirement as for
the registration of the aircraft... Of course the operator of the
aircraft would in that construction be the US-trust or whatever
possible entity.
