NY State wants to fingerprint student pilots

[Roy Smith]

A bill has wound its way through the NY State assembly and senate
which would require fingerprinting and criminal background checks for
all student pilots.

SUMMARY OF SPECIFIC PROVISIONS : This bill would:

* require any aeronautical facility, flight school or institution of
higher learning to require an applicant for flight instruction to
provide criminal history information to the Division of Criminal
Justice Services (DCJS);

* require such flight institution to request criminal history
information of any new and prospective applicant from DCJS;

* authorize DCJS to exchange with and request fingerprint data and
criminal history information from the Federal Bureau of Investigation;

* make it a misdemeanor for any person who willfully permits the
release of any confidential criminal history information to persons
not permitted to receive such information;

* allow an institution providing flight instruction to request from
new or prospective students their prior criminal convictions in New
York State;

* require the Commissioner of DCJS to determine whether clearance for
flight instruction shall be granted or denied to a new or prospective
applicant;

* prohibit an applicant from receiving flight instruction from a
flight institution unless DCJS first has provided written notification
to such institution that the applicant may receive such instruction;
and,

* direct the Commissioner of DCJS to promulgate rules and regulations
necessary to implement the provisions of this section.

JUSTIFICATION : Due to the attacks of September 11th, 2001, there is
an urgent need for greater security in the aviation industry.
Accordingly, requiring background checks for any person requiring
flight instruction from flight schools is an effective screening
measure in order to meet these heightened security demands.

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS : None.

EFFECTIVE DATE : This act shall take effect on the sixtieth day after
it shall have become a law.

Didn't we go through this nonsense with Michigan a year or two ago? They
were also wanting to stick their noses where they have no authority or
jurisdiction.

Pilot training and certification is a federal matter: I'd be happy to
see the Feds tighten the application process, but NY should learn it in
fact is not a seperate nation although some residents might think so.

How would you even attempt to enforce legislation such as this? Time to
write AOPA.

Is this anything new? This has been the case for millions and millions of
people in the USA for several years already. And the irony is that each and
every one of those millions of people went through a criminal background
check and fingerprinting already and each and every one came out clean. For
those not required to do the fingerprinting and background check for every
major rating you would not know. It just didn't make any headlines.

Millions and millions? I don't see that many fresh immigrants applying for
flight training.
And of course they all came out clean (as far as you know). Laws only work
for law-abiding citizens.
