this group...
I'm willing to even kick in a few bucks to make it happen...

Well there the rec.aviation.stories Larry is the mod though.
You know -- I was just thinking a rec.aviation.piloting.moderated would
be a darn good idea. Doesn't need a few bucks as much as it needs a few
volunteers to moderate, and one of the downsides is some degree of
latency when posting articles (i.e. they need to be approved by the
moderator).
Has this topic come up in the past? Lot of good content on this NG.
Also a lot of bottom-posted, cross-posted fckwt sht too, and that is
getting to be a bit of noise.

There are many costs in setting up a .moderated group,
financial, personal, and social.

Assuming suitable moderators can be selected who are willing to
dutifully fulfill their responsibilities over the decades, there is
also another little matter to address before they will be needed.
There is a formal process to create a newsgroup under the big-8. You

to be formal discussion that complies with the guidelines, and a vote.
Personally, I prefer to accept the noise if means avoiding censorship.

Moderated lists almost invariably die a slow death. Moderation is censorship
and is never very popular, and moderation is a very difficult and
time-consuming job that most people cannot handle. Lots of people want to
have the authority of moderators, but virtually none want the responsibility
or the ethical obligations.
That is why virtually all newsgroups on USENET are unmoderated.

The first line of that FAQ notes that it is now obsolete.

I have served as a moderator for 10 years and I do not
view what we do as "censorship." YMMV.
Having said that, I know full well that moderation produces
a very different kind of group and that it does not cure all
ills.

I back that strategy. If I had known in 1998 what I know
now, I probably would not have volunteered to act as a
moderator. Live and learn.

It is virtually impossible for any newsgroup not to talk
about the health of the newsgroup from time to time. Using
consistent subject lines will help people decide whether
they want to read the thread or not. So I'm not going to
tack on anything about my most recent adventures in
General Aviation (they aren't all that recent).

Most of the type specific groups I've been involved in have been
moderated. They work because the moderator exercises an extreme amount
of restraint. Most would argue they wish the moderator would kick
people off sooner but I think the greater good is best served when he
does not. Its too easy for a moderator to kick someone off because
they don't agree with his opinion.
In fact, the most successful moderated groups seem be those where the
moderator is nearly absent and only gets involved after several
complaints. An active moderator deleting posts etc just leads to
frustration.

Reading through a lot of the responses, I'd say that getting a new NG
"approved" is a non-issue, and I personally have the resources to make
the technical end of it be a non-issue.
The challenge is finding a group of 3-4 moderators for redundancy and
workload sharing that have the right attitude to "moderate", and not
"censor".
One of the notable things on m.i.f-p is that it is not moderated for
correctness or quality of content, it is moderated to filter out the
chaff, flames, structurally poor postings (e.g. no trimming), O/T stuff,
spam, etc. I think it's this liberal moderation policy that has
resulted in the m.i.f-p's group's longevity and success.
Just for an at-home example, Most of Mxsm...'s initial posts, and
on-topic followups would be allowed in a "well-moderated" group (but not
the flames that he baits). One may not agree with him, think he is
right, think he is beautiful, has an ATP, or speaks from any authority,
but the discussions do (often) start out on topic.
Bottom line is that success lies in getting enough of the right moderators.

for a start don't use google-groups (but a real newsreader connecting to

That is my personal bugaboo. I learned long ago that quotations weren't
supposed to be an archive of the conversation but merely a reference point for
your answer. How many layers of crap do there have to be before I give up? My
screen resolution is 1280X 1024. If I don't start to see some new material on
the page, I won't scroll down to try to find it. I just move on to the next
message.
It seems to me if an author wants somebody to read his words of wisdom, he'll
make it easy to find them. Otherwise he's done nothing more than fart in a
gale.
We don't need moderation. We just need folks to pay attention to what they're
doing.

There can be another issue with moderated discussion.
I recall a law suit that ultimately resulted in AvWeb changing hands.
It was over some inflammatory posting that the moderator(s) chose not
to censor. It seems, that once censorship rears its head, the
potential for legal recourse follows closely behind.....

As much as I do not like the idea of moderation, it would cure a problem beyond
people not paying attention. It could get rid of several fujwits that have done
nothing but pollute the place, and run off many people who finally felt the
effort to stay was not worth it.
It has merit, IMHO.

I haven't heard of any cases of such lawsuits derived
from participation in a moderated Usenet newsgroup.
Usenet is not a website.

Creating a moderated group such as rec.aviation.piloting.moderated or even
just rec.aviation.moderated does have some advantages and problems:
Advantages
1) The unmoderated groups would continue to exist for those who dislike or
object to their posts being vetted. They can't cry censorship simply
because they still have the same old groups.
2) If the moderated group dies or never gains traffic, the unmoderated
group still exists and again, no harm, no foul.
I'd be willing to help with the technical details and act as a co-moderator
should enough qualified co-moderators volunteer. I've written moderation
software that is currently being used for 5 moderated groups and is
designed to handle multiple co-moderators. It does require installing the
Python programming language onto a machine (either Linux or Windows) and
installing a GUI application onto the machines of the co-moderators.
There are essentially no technical problems to overcome. But...
Problems:
1) Decent coverage would require moderators to check in several times a
day, every day, for the life of the group. No time off for good behavior.
2) Finding decent moderators. Ones with the right mix of diplomatic skills
and the proper amount of humility. The ones who would approve a topical,
non-inflammatory post that they otherwise strongly disagree with and who
would reject a non-topical or inflammatory post they strongly agree with.
One aid to objectivity is having a way to limbo a post so it can be vetted
by multiple co-moderators. The software I wrote allows just that.

As soon as the host of a discussion forum exerts any editorial control over
the content, he becomes jointly responsible for that content, and can be sued
over a post, a deletion of a post, or allowing a post to stand, just like the
author of the post. This is a huge danger to moderating discussion forums,
and a good argument not to do it in many cases.
If a moderator limits deletions to things that he is legally required to
remove, he may escape some liability, but it's risky. In any other case, with
more extensive moderation, he risks being assigned full responsibility in any
litigation. And justifiably so, in most cases.

Disagree. Sadly, this group has sunk to the point where MX is now the

I never would have thought it could come to that, but the trolls have chased

Is my memory correct that the 9th Circuit is the one most often
reversed by the Supremes? If so I doubt I'd want to test those legal
waters until it's supported at the highest level.
That's especially true when the effort itself would be as a volunteer!
It's interesting that moderating is really what peer review is all
about, and I know of no professional journal that has been sued for
either publishing or not publishing a submitted article. Full
disclosure here, I have not researched that, but being active in that
wourd I suspect I'd have known, had it happened. Suing the medical
professions, after all, is great sport, is always in season, and
there is no bag limit.

Cyberspace Exceptionalism
47 USC 230 was enacted in 1996 during the height of "cyberspace
exceptionalism," the belief that the Internet was
unique/special/different and therefore should be regulated

postpone or alter content do not transform an individual into

Rosenthal, 146 P.3d 510, 528 (Cal. 2006) (relying on Batzel
in reaching its conclusion that “[a] user who actively selects
and posts material based on its content fits well within the

that role from liability”). Although not expressly addressed by
our case law, a “publisher’s traditional editorial functions”
also include seeking out and specializing in a specific type of
publication, just as in Batzel, where the website operator operated
a website dedicated to a specific topic (museum security
and stolen art). Batzel did not suggest that this fact made the
operator an information content provider.
In sum, our binding precedent has already addressed the
question when a website operator has jointly created and
developed content so as to become an “information content
provider.” Unless a website operator directly provides “the
essential published content,” Carafano, 339 F.3d at 1124, it
is not an “information content provider.” The result is robust
immunity under section 230(c).

Doe v. Friendfinder Network, Inc., — F.Supp.2d —-, No. 07-286, 2008 WL
803947 (D.N.H. March 28, 2008)
Plaintiff Doe learned that a nude image and some biographical
information about herself had been used to set up a bogus profile on
the adult-oriented personal-ad Web site Adult Friend Finder. She sued
the operator of the site alleging a number of claims, like defamation
and intentional infliction of emotional distress. She also alleged
misappropriation of her right of publicity under state law, and false
designation of origin and false advertising under the federal Lanham
Act.
Adult Friend Finder moved to dismiss the claims, arguing that the
Communications Decency Act (”CDA”) at 47 U.S.C. 230 immunized the site
from liability for the information provided by someone other than the
site operator. The court agreed with Adult Friend Finder as to the
majority of the claims, holding that the claims were barred by the CDA
where the plaintiff sought to impose liability on the site as the
publisher or speaker of the information.
But the court held that the CDA did not immunize Adult Friend Finder
from Doe’s state law claims for violation of the right of publicity,
or for violation of the federal Lanham Act.
Section 230(e)(2) provides that “[n]othing in this section shall be
construed to limit or expand any law pertaining to intellectual
property.” You may recall that last year the Ninth Circuit [in Perfect
10, Inc. v. CC Bill, LLC, 488 F.3d 1102 (9th Cir. 2007)] held that
230(e)(2)’s restriction on immunity only applied to federal claims
involving intellectual property (leaving state law claims barred).
The court in this case disagreed with the Ninth Circuit on this point,
looking at the plain language of the statute and finding no meaningful
distinction between state and federal causes of action involving
intellectual property, especially given the presence of the word “any”
when decribing “law[s] pertaining to intellectual property.”

This is getting absurd. It wouldn't have mattered if there had been no case
law. The simplest way to avoid the issue is for the moderators not to
approve anything potentially libelous. Those sorts of posts are easy to ID.

It would depend on the group charter. For example, if you had asked how to
perform finite-element-analysis of landing gear on a moderated group
chartered for discussion of piloting, it would have been rejected as off
topic with suggestions on a more appropriate group. Asking questions
relating to backwash on lift - borderline. Would have approved as "hangar
talk".
And ad-hominem's would be rejected too. That's standard operating procedure
for moderated groups - unless the moderator(s) are trying to kill the
group. Or such things are chartered as on topic!

The Ninth Circuit's decision in Batzel vs. Cremers is merely a precedent, not
a law. The dissent raises many good points that can be put to use in
subsequent cases, although it does suffer from the specific inconsistency

In principle, I agree with your statement as written; but there are
problems:
1) "Moderation" is undefined and, although I have never been directly
involved with moderated newsgroups, I can think of several methods which
function differently.
2) "Peer" is undefined--and a very tempting topic of discussion. Suffice it
to say that, IMHO, "peer" tends to be narrowly defined in professional
peer-review and in selection for "juried" art exhibits; but broadly defined
in a lot of other areas. Remember that the different methods of
"moderation" interact with this.
3) "Standing" is a legal term and, since I am not a lawyer, I will just
presume that other readers understand the meaning in much the same way as I
do. It's another great area for discussion--on another group or, better
yet, at a cocktail party.
4) "Jurisdiction" is another legal term--with similar caveats to "Standing"
and possibly an even more entertaining discussion--properly fueled with
C2H5OH.
5) Work load in the courts--at least in parts of the U.S.A.
There is no question at all that some level of moderation could be a great
blessing for this group--even if it only prevented follow-up posts by one
especially notorious contributor of new threads. But, in the end,
moderation is a lot of mostly thankless work, a moderated group is a lot of
work to set up, and there is a much greater risk that the group will die off
rather quickly.

If you look, you can probably a lot of aviation groups that are already
moderated, hence the problem with this group. We get all the problem
children not allowed elsewhere.
The problem is finding one with a moderator that is either unusually fair
and gifted. Very few people possess the attitude to make a good moderator.
You need someone with at least 10 years experience in the topic of the
group, and 10 years experience running a day care center.

I took the trouble to review that thread up to a point, and could find
no ad-hominem attacks against you in the first 107 posts (in the order
given in that link). Some posters who I would loosely categorize as
"does not suffer fools gladly" such as perhaps Bertie, actually posted
useful followups (4, 9, 20, and 86, among others). There were attacks
against Mxsmanic, but that's an ongoing thing unrelated to your initial
post.
You didn't start getting personal nits until your post at 91 of that
thread in which you state "Let's face it. A large pecentage of people
walking this planet think there is a "suction" force."
That was essentially an attack on "a large percentage of people." If I
had been a co-moderator of a moderated piloting group with that thread,
I'd probably have approved your post 91 and Bertie's followup post at 92
because his "lost cause" statement was basically a statement about why
he'd not be trying to answer any further. But I might have included a
moderator warning of some sort.
The first real insult against you appears to be at post 108 by Bertie.
But it is response to post 107 by you in which you basically engaged in
a personal attack against two unnamed CFIs. Post 107 of yours was
borderline inflammatory - had you named names I'd have rejected it.

Other than the attacks on Mxsmanic, I saw lots of reasoned posts
directed in response to your post and from you in at least the first
100+ posts. People appear to have put a lot of effort into their
responses but you insisted on both claiming in need of some intuitive
understanding on one hand but on the other hand claimed to already
know all the physics and intuitively knew what was going on.
(A confusing mix of hubris and humility.)
Basically you appear to have been claiming knowledge and understanding
on one hand but claiming you needed help in gaining that very same
knowledge and understanding on the other. That in summary is possibly
why you were eventually pegged a troll and then personally attacked.

This is true. It is not meant as an insult, and many of the people
who think there is a suction force do not see what the big deal is
until after they have learned, not from me, but from someone whose
opinion they trust, that indeed, there is no suction force, so it can
hardly be seen as a personal attack against them, because they do not
yet know that what they think is incorrect. In any case, it is not
meant to be a personal attack, but simply an illustration that what
people perceive is not necessarily what is actually happening.

We obviously have a difference in opinion here. I see multiple attacks
from multiple people early in the discussion.

Those were not attacks against the CFI's. Those CFI's never read this
group. Secondly, stating that at CFI does not know the physical basis
of 29.92 is not necessarily a personal attack. What does it mean to
not know? It simply means that that CFI does not know.
When I grade exams in computer science, and I give someone a sub-par
grade because it is apparent that they do not understand, is that a
personal attack? Should I write, "You're getting a C-. Please don't
take it personally....I'm not attacking you, it's just that it is
clear that you do not understand...." on every exam?
I think a bit of objectivity is in order. Calling someone names using
expletives, or calling them dumb, or saying, "No way in hell are you
an engineer..." those are personal attacks. Stating that a CFI does
not know the physical significance of 29.92, who, by the way, readily
and voluntarily admitted that he did not know, is not personal attack
at all, IMO. It's a simple fact. Since you broached the subject, I
actually had more respect for him after he admitted not knowing than I
would have had for someone pretending to know.

I saw a few reasoned responses, and many ad hominem attacks, more of
the latter than the former, the entire thread considered. For example,
you mention, "Other than the attacks on Mxsmanic"...but if you read
the thread, you will see numerous claims that Mxsmanic and I were
being declared to the the same person, with insults directed at both
of us.

So...you are saying I was attacked or not? It cannot be both.
Also, I viewed that thread as a discussion, not a request for
knowledge. Wikipedia is ominpresent. I have CFI's available. I have
my Jepp books. I have FAA web site. There are university online
resources. I have the bookstore. Sources of knowledge is readily
available.
What I expressed was my own opinion about backwash and lift, which
conflicted, at the very least, with the idea that the basics of lift
were already well-understood by pilots.
I think that the people who attacked me were unnerved by the idea that
something that they were supposed to have learned and understood was
being revisited by someone not possessing a pilot's license.
In any case, if the discussion had pertained to things I do know
about, like electronics, chemistry, or computers...the last thing I
would have done was personally attack the poster.
I do not think that is necessary. For any reason.

Actually, it is law...in the Ninth Circuit. It is binding in the
federal courts in that Circuit, just the same as a statute. It is
called "common law."

There is just no way that I am going to actually conduct a rigorous
statistical analysis, but casual observation strongly suggests that MX also
remains the primary source and catalist for off-topic posts. There are
others, from time to time; but they lack his long term tenacity.
As mentioned earlier, I am not an advocate of moderated groups and just two
of my reasons are that I would not want the job and also that I am convinced
that a tired moderator could quickly become worse than non at all. But I
must admit that the much could be gained.
As always, YMMV

Although I follow a few moderated reflectors, I avoid moderated groups
like the plague. I enjoy the ability of the groups to drift "a bit
OT" now and then. Every moderated group I've tried eventually ended
up so strict I left them. Now I don't even bother.

Yeah, I've even been giving him a step by step as to how i've been
playing him and , like any k00k worth his salt, he just ignores what I
say. It's kind of the acid test for a real long distance sort of k00k.
