Three points.

1) The EAA doesn't own "EAA"
2) The fact that the site is attractive, well laid out, etc has been
compromised by this lame attempt at SPAM

In this post it wasn't my intention to discourage SPAM it was my
intention to discourage trademark infringement. And I sent an e-mail to
EAA as well to further that goal.

When discouraging trademark infringement when the OP wasn't infringing
the trademark, as if you could, DON'T QUOTE AND INCLUDE THE

If it intrudes on their space (which it does) then you cannot. If your
name is McDonalds you cannot open a burger shop in your name but you
could sell lady's underwear under than name if you choose. It just has
to create confusion for customers. In addition it only applies where
you do business (i.e. there can be a A-1 termite company in Los
Angeles and New York that don't intrude on each others space). In this
case the OP is Canadian I believe, I'm not sure if there is an EAA
presence in Canada or not.

....and that's a crock, because the wrestling federation was in a completely
separate area of trademarks. The British court that made the wrestling
federation change the name, frankly, screwed up.

Actually courts have shut down many websites for using a protected
name inside their domain name. Remember, the legal standard is that if
it can create confusion for a customer. To the extent that it detracts
from EAA's name they can be held liable.

Here's the bottom line. Is the EAA pressing these folks to punt their
EAA which is www.xxxEAAxx.com? No. You have brought this to their

The US doesn't own the internet but in this case the IP in question is
in the US and subject to US trademark law. Whether the EAA chooses in
this case to defend the trademark in this case has little to do with
either of us being right or wrong.

I think you aren't reading my entire post. It has to create confusion
to the consumer to be an infringement. For instance
mcdonaldsburgers.com would be an infringement but mcdonaldsundies.com
would not.

OK, I'll buy into that. When you hit the opening page of their website,
it clearly says their real name by their logo, that is a CAA ground
school (and other offerings). I never thought it had anything to do with
eaa.org.

I'm more confused about EAA.org than the OP, giving away a Cirrus. lol

Well, precisely. Maxie is a typicla lamer. He's tried al the usual
stuff. IKYABWAI, gay lames, fatt ass lames. meds lames. But in his
defence, what he lacks in imagination, he more than makes up for in
cluelessness.
For instance, hes been honking on for weeks about forgeries. Of course,
noone is forging him and if they were he could get them toasted, but he
seems to think it;s some sort of slur or something and that the world
will turn against me.

But his most endearing trait is I keep him completely up to date on my
MO and my intentions and it only surs him on to new heights!
He'll take this poast, for instance, as a sign that his "campaign" is
working and that he has me on the run..

galloshes/gumshoes/wellies on ( this is an international forum, after
all) and see if I could find one that came nearly up to the edge of my
