Especially under the current rules, under which there's no penalty for
a frivolous protest. Even if you think you have only a slim chance of
winning the protest, it's a slim chance to score a multibillion dollar
contract with the only cost being the time your legal team spends on
it- which is comparative peanuts. I read an article on DefenseTech in
which an Air Force procurement officer stated that protests of the
contract award are considered pretty much inevitable, to the point
where they're starting to build time into their project schedules to
deal with them.
Unless the rules change I predict that the vast majority of future
major defense contracts will have to deal with some kind of post-award
protest.
