You mean like the evangelists in Peru?

I believe, that if the intruder aircraft is able to communicate with
the intercepting aircraft on 121.5, and its pilot complies with
instructions, the likelihood is not too great that an innocent
'intruder' will be downed. It is to the advantage of the errant
intruding flight, that it be detected and challenged as near as
possible to the time it enterers the TFR. It would be my guess, that
the shoot-down trigger is expressed as a distance from a specific
point; any unidentified aircraft within that distance is probably
deemed a threat and therefore a target. But, I'm just gussin'.
