Creative writing is an ambiguous term. If you meant fiction, no the event
occurred and was transcribed that afternoon. CJ filed an ASRS report the
following day regarding a violation of FAR 91.159 and made me wait until
after he received the ASRS receipt from NASA before allowing me to make it
public. Somewhere in the warrens of Joshua Approach, there lies an
incriminating tape recording of the event.

Why file the ASRS report? The even/odd altitude thing is a recommendation,
not a requirement, and CJ managed to see and avoid, so what was the big
deal?

Nope, it's a requirement. It says in 91.159 that (other than for some
specified exceptions) a pilot "shall maintain the appropriate or altitude or
flight level prescribed below". "Shall" isn't just a recommendation.

I'm confused on how FAR section 91.159 can be read where it isn't a
requirement. Could you elaborate?

The "even/odd altitude thing" is required by regulation, it is not just a
recommendation.

§ 91.159 VFR cruising altitude or flight level.
Except while holding in a holding pattern of 2 minutes or less, or while
turning, each person operating an aircraft under VFR in level cruising
flight more than 3,000 feet above the surface shall maintain the appropriate
altitude or flight level prescribed below, unless otherwise authorized by
ATC:

(a) When operating below 18,000 feet MSL and-

(1) On a magnetic course of zero degrees through 179 degrees, any odd
thousand foot MSL altitude +500 feet (such as 3,500, 5,500, or 7,500); or

(2) On a magnetic course of 180 degrees through 359 degrees, any even
thousand foot MSL altitude +500 feet (such as 4,500, 6,500, or 8,500).

(b) When operating above 18,000 feet MSL, maintain the altitude or flight
level assigned by ATC.
