A "dry lease" is a business decision, not a regulatory requirement.

Regarding the renting, I was looking for a FAR reference I could look
up, but it is clear enough there isn't one. This has become yet
another tale which gets repeated by enough people...

Regarding the dry lease requirement, nobody has come up with a reason
for that either (here or elsewhere).

Again.. practical "need" is not a "legal requirement". Maybe the lawyer
wanted the business of drawing the lease up or something.. or was
protecting his turf in doing that sort of business.

That I can understand. What is bizzare is that I have heard from a
person who says he is a qualified NY lawyer state that the need for a
dry lease comes from some sort of interaction between the FAR
requirements and renting an aircraft outside the USA.
