asked about getting rights to use
land for aviation/gliding uses near JeffCity Mo.

Hello Ozvena,

I. Aviation Uses on Farmland - Yes. One may arrange
use of another's land for glider/aviation use subject
to certain considerations.

Memphis Soaring Society, for example, has had various
land use arrangements and sites of operation from time
to time. They now own their site, and a winch, and
towplanes, and are selling homesites on airfield.


Other persons have leased, rented, and have or have
had permissions to operate on farmland or on other
land.

II. Method - There is no particular method of doing
this.

It is open to definition by negotiation, exploration,
and agreement.

III. The Conditions of the Area for Gliding -
As to the Jefferson City Missouri area,
that area should provide for good gliding.
No doubt in my mind.

IV. How to Start -

To make the start,
you will need a site, public or private.
An inexpensive useful intro 2 Seater glider
such as a SGS 2-33;
A launch method or two
whether it shall be winch,
autotow, pulley, aerotow.

You will need to recruit fellow enthusiasts
and campfollowers.

V. Who to Start -
You may be the sparkplug to pull this together.

It is probable that if you do it the others will come.
With a start toward the objective
you will attract help
and shared enthusiasm along the way.

VI. Existing Resources/Sites -

Do not overlook existing airfields, public or private.


These offer potential for operational site.

VII. Private Airstrips -

As to private airstrips, there may be someone who owns
an airstrip, mows it, and has little activity there
who may be open to your uses because they are tired
of having little shared fun for all the mowing done
and they may be willing to receive some income to help
offset the ag land taxes cost.

re obtaining a land site and use - Certainly, as freemen
in America, you may arive at any agreement mutually
agreeable. That's it.

VIII. When to Start /Elements Needed -

The key is to start now, as follows:

identify prospective sites - with
a. clear approaches,
b. good surface such as grass, pavement, or hardclay
without holes and pretty level,
c. good natural drainage after rain,
d. reasonable accessibility (gate or off road or
on farm?),
e. located where it would not be construed as a nuisance
to neighbors if any,
f. unimpaired by local governmental restriction
of use
(basically, a farm upon which you might operate not
up against a neighbor will provide good site),
g. annual usability, if grassed, who will keep
it mowed ?
h. can improvements be made (clubhouse, aircraft
shelter, fuel-drum shelter).
etc.


IX. Public Airfields -

It is very important to not overlook the resource of
public airfields. Many are not much used and may
provide just what you need.

It is a fact that there may be disused or hardly used
public airfields around your area. Go visit. Eyeball
, walk , talk, without saying too much.

Look for them; find them.

X. Do Not Ask Permission where Permission is Inherently
Available -

Be careful to not ask permissions. Just identify good
candidate public airfields. Just identify. Then
eyeball and assess, and then make courteous greetings
and presume that you may operate there. If it is public
airfield, you may.

Big mistake to ask permission at public airfield.
Operate there. Big mistake to ask permissions to
aviate at a public airfield. You have rights to aviate
there. So, dont ask. Courteously announce.

XI. Ag Land and Std Usage Agreements -

Ok, now as to usage of ag land:
When you have identified prospective site, then you
may approach owner or tenant with rights to lease with
the same form of proposal that they may be familiar
with already. Many andowners are familiar with and
use DeerLease Agreements or other hunting agreements
which involve use of land.

Therefore, find rates for and agreements used with
DeerLeases and hunting clubs in the area. Make
a proposal to owner or tenant with rights to bind for
use of the land according to your needs.

Define therein your glider launching and access to
land, times and days there for, who shall have access
and rights, flying club member use, etc. for glider
launching and take off and landings, meeting and camping
of glider club members, and talk fee.

When fee rental payment is agreed, then define rights,
agreed uses, termination procedures by both parties,
notices required in writing, termination procedures
etc.
When agreed, do it.

For a lease, or other use agreement
with party with authority to bind:

XII. Elements of Contract -
the agreement should meet all the elements of contract.


That is to say, the parties, the agreement should meet
the elements of contract....that is the parties, the
place , the date, the start and term and expiration
of agreement, the rights and uses purchased or rented,
the fee and method and time of payment (valuable consideration),
the method of termination or cancellation and notice
required, method of extension or modification of agreement.
signatory parties, and signatures, date and witness
or notary.

However, if to enter into landuse agreement, see if
there is a standard DeerLease form in use in the area;
if so then adapt that format to your needs, and form
may be either formal in contract form or rather informal
in letter style but containing all the elements and
authorty of contract.
