Then the only way to descend is to request and get cleared for a Contact Approach? Check out 91.175(b)(1). It all depends on your interpretation of "normal rate of descent" and "normal maneuvers." Only you know if you're making normal flight maneuvers or "ducking under" and the only way we'll know if you were ducking under is if somebody peels you off the side of a hill.
