FARs said it should have had one.

Well, the alternatives in this situation are pretty simple: A] No ELT signal has been detected, therefore perhaps 1: It failed to function (dead battery; destroyed in crash) 2: The aircraft did not experience an 'impact' strong enough to activate it 3: Mr. Fossett did not or was unable to activate it manually. B] No radio distress calls have been heard, therefore perhaps 4: The aircraft's battery was destroyed in the crash 5: The radios were destroyed in the crash 6: Mr. Fossett exited the airplane and was unable to return to it (lost, incapacitated) 7: The battery shorted out. 8: Mr. Fossett has been incapacitated or had sudden cardiac death, without a crash. 9: (hardly likely) Mr. Fossett has deliberately disappeared. Or some combination (e.g., 2 + 6 -- landing on a dry lake that was crusty, the wheels fell through; Mr. Fossett exited the aircraft to investigate and fell through himself and was incapacitated thereby; not very likely, especially in August) But none of this helps find the airplane, a tough thing to do if it's not on level ground.
